The Constitutionality of Geofence Warrants: A Discussion on Federal and Minnesota Perspectives
Earlier this year, the Minnesota Supreme Court analyzed the constitutionality of geofence warrants in State v. Contrera-Sanchez—an issue that has been long overdue with the advent of cell phone location data in criminal investigations. However, the Minnesota Supreme Court’s decision interpreted the Minnesota Constitution, which has been at times more protective than the Federal Constitution. Currently pending before the U.S. Supreme Court is the issue under the Federal Constitution. Please join us for a panel discussion exploring the reasoning under Minnesota’s Constitution and various predictions on the Federal landscape from the perspectives of current prosecutors, public defenders, civil rights organizations, and academia.
